We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and by updating any privacy information on this page. Your continued use of the Site and or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) your agreement to abide and be bound by that Policy. IMPORTANT: BY USING THE SITE AND/OR OFFERINGS AVAILABLE ON THIS SITE, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THE SITE.

1. Types of Information We Collect

In order to better provide you with our products offered on our Site, we receive and store any information you enter on our website or give us in any other way. Information collected can be narrowed down into several categories indicated below.

Personally Identifiable Information (“PII”). This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this Site, such as registering for an account, downloading or purchasing a product or service, submitting content and/or posting content in the user forums, or sending us feedback, we may ask you to provide certain information about yourself. This includes information that can identify you, including your first and last name, electronic signature, telephone number, postal and email addresses, and billing information (such as credit card number, cardholder name, and expiration date). We may also request information about your address location to verify the address information. You can choose not to provide information to us, but in general some information about you is required in order for you to register as a member; participate in a survey, contest, or sweepstakes; ask us a question; or initiate other transactions on our site.

Aggregate Information. This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Site and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website’s Uniform Resource Locator (“URL”) that points to the site you just came from, which URL you go to after visiting our Site, what browser you are using, and your Internet Protocol (“IP”) address.

Automatic Information. We automatically collect some information about your computer when you visit this website. For example, we will collect your IP address, Web browser software (such as Chrome, Firefox, Safari, MS Edge), and referring website. We also may collect information about your online activity, such as products viewed and orders made. Our goals in collecting this automatic information include helping customize your user experience and inhibiting fraud.

Information from Other Sources. We also may periodically obtain both personal and non-personal information about you from affiliated entities, business partners and other independent third-party sources and add it to our account information. Examples of information we may receive include: electronic signature, updated delivery and address information, purchase history, and demographic information. The information may include your name, email address, profile picture, gender, and other information that you authorize us to receive. Depending on the privacy settings of you and your friends, we may access information that you provide to a social media provider regarding your respective locations ("Location Data") to provide you with relevant content. Please note that your Location Data may also be shared with your friends on a social media provider in accordance with your privacy settings for that social media provider.

E-Postcards: We may provide electronic postcards cards via our websites and our affiliate websites for you to send to a friend. We store the e-mail address of all recipients, the message you want to send and the URL for locating the greeting card. We do not sell, distribute, or license in anyway the use of recipient e-mail addresses. We use them solely for the purposes of notifying recipients on your behalf that a card is waiting for them at the designated URL. After 30 days, all information pertaining to your postcard is deleted.

Electronic Signatures. Periodically in order to verify the identify, location, billing information and ownership of methods of payment of users, we will request to obtain an eSignature form you through affiliated entities, business partners and other independent third-party sources that use electronic and or digital signature services. Such services shall be compliant with all major eSignature laws including ESIGN, UETA, and European eIDAS and maintain SSL encryption.

Ownership of Data: NATURE’S IDEAL, LLC owns the data collected on our Site.

2. How We Collect and Use Information

We use information about you for the following general purposes: to provide you with the products you request; to provide you with order confirmation and updates; to manage your account, including processing bills and providing order notifications; to communicate with you in general; to respond to your questions and comments; to measure interest in and improve our products, services, and website; to notify you about special offers and products or services that may be of interest to you; to otherwise customize your experience with this website; to reward you as part of any reward and recognition program you choose to join; to solicit information from you, including through surveys; to resolve disputes, collect fees, or troubleshoot problems; to prevent potentially prohibited or illegal activities; to enforce our Terms of Use; and as otherwise described to you at the point of collection.

We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when for the purpose of completing the order you conduct on our site and or elect to use certain products or services available on the Site. These may include: (a) registering for an account on our Site; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting a form or transmitting other information by telephone or letter; or (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. When processing certain information, such as payment information with affiliated banking institutions or payment processors, we encrypt the transaction, using strong Secure Socket Layer (SSL) encryption technology, in order to prevent your PII from being stolen or intercepted. Additionally, your credit card information is encrypted and stored on a restricted-access database that is away from our main Site and only accessible by authorized users.

We will primarily use your PII to complete the order you conducted on our site and or to provide product or service offerings to you. We will also use certain forms of PII to enhance the operation of our Site, improve our internal marketing and promotional efforts, statistically analyze Site use, improve our product and service offerings, and customize our Site’s content, layout, and services. We may use PII to deliver information to you and to contact you regarding administrative notices. Finally, we may use your PII to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Site Terms of Use, and this Privacy Policy.

We may also collect and or our third-party advertising partners may collect, certain Aggregate Information. For example, we may use your IP address to diagnose problems with our servers, software, to administer our Site and to gather demographic information. Our third-party advertising partners may also provide us with aggregate, but not individual, reports that will tell us how many ads were presented and clicked upon at out Site.

EEA Visitors Only: Our legal bases for processing personal information.

If you are a visitor from the European Economic Area, our legal basis for collecting and using the personal information described in this Privacy Policy will depend on the personal information concerned and the specific context in which we collect it. We will normally collect personal information from you only (i) where we need the personal information to perform a contract with you, (ii) where the processing is in our legitimate interests and not overridden by your rights, or (iii) where we have your consent to do so. In some cases, we will have a legal obligation to collect personal information from you such as where it is necessary to use your transaction history to complete our financial and tax obligations under the law.

If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not.

If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our platform and communicate with you as necessary to provide our services to you, for security verification purposes when you contact us and for our legitimate commercial interest, for instance, when responding to your queries, improving our platform, undertaking marketing, or for the purposes of detecting or preventing illegal activities. We may have other legitimate interests and if appropriate we will make clear to you at the relevant time what those legitimate interests are.

How do we determine what our Legitimate Business Interests are?

We carry out an assessment to ensure that: (i) Our interest in the use of your data is legitimate (i.e., we have a clear business need); and (ii) The business need, on balance, does not override your privacy rights. When determining this, we assess the potential impact a specific use of the data may have on you as a customer and weigh this against our own reasonable business needs. We also apply a series of security measures to minimize any potential risks.

By way of example in practice we would consider that the collection of our customers’ marketing preferences in the course of a product order is a legitimate business interest to have as an online ecommerce company. We believe that this does not unduly impact your privacy rights as you may want to hear about our products and services going forward. However, to protect your privacy rights we ensure that you can opt out of these promotional communications at any time, in your account, in the email itself or through customer services.

In accordance with the legal grounds above, we use the information we collect to: to provide you with the products and services you request; to provide you with order confirmation and updates; to manage your account, including processing bills and providing order notifications; to communicate with you in general; to respond to your questions and comments; to measure interest in and improve our products, services, and website; to notify you about special offers and products or services that may be of interest to you; to otherwise customize your experience with this website; to reward you as part of any reward and recognition program you choose to join; to solicit information from you, including through surveys; to resolve disputes, collect fees, or troubleshoot problems; to prevent potentially prohibited or illegal activities; to enforce our Terms of Use; and as otherwise described to you at the point of collection.

If you have questions about or need further information concerning the legal basis on which we collect and use your personal information, please contact us at the information provided at the bottom of this Privacy Policy.

5. Release of Information

We will not sell, trade, or rent your PII to others. We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). 8. Security of Your PII

At our Site you can be assured that your PII is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII. For example:

  • We work hard to ensure that the data we collect is reliable, accurate, complete and current. We encrypt all PII, in order to prevent unauthorized parties from viewing such information when it is transmitted to us. We also only keep collected information only for as long as reasonably necessary and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.
  • We limit access to PII only to specific employees, contractors and agents who have a reasonable need to come into contact with your information. For example, we may provide members of our technical support team with limited access to your account in order to allow them to troubleshoot problems you may be having with the Site. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
  • Additionally, we also employ a number of physical, electronic, and procedural safeguards to protect PII. Our secure servers and our data centers are protected by industry-standard encryption, and our servers reside behind firewalls and employ high-level password protection.
  • Finally, access by you to your PII is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone.

To most effectively serve you, credit card transactions and order fulfillment are handled by established third-party banking institutions and processing agents (such as PayPal). They receive the information needed to verify and authorize your credit card or other payment information and to process orders.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

9.Data Retention

We retain the personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise the data or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. We will anonymise or aggregate your data if we intend to use it for analytical purposes or trend analysis over longer periods.

10. International Data Transfers – EEA Only

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident and outside of the EEA. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective.

Specifically, the servers of our Online Services are located in the United States, and third-party service providers operate around the world. This means that when we collect your personal information we may process it in any of these countries. We have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Policy when transferred outside of the EEA.

We ensure that any of our third-party service providers to whom a data transfer is made has appropriate safeguards in place to protection your personal information. The adequacy mechanism may be (i) adequate country status, i.e., based in a country that the European Commission has deemed "adequate" since its data protection standards are similar to the European Union; (ii) Standard Contractual Clauses; or (iii) the EU-US and Swiss-US Privacy Shield.
